Lesser murder conviction upsets widow - Vancouver, BC - The widow and friends of Ben Banky - a well-loved business owner shot dead by a fired employee at a company Christmas party - say they're disappointed his killer was convicted only of second-degree murder.
A B. C. Supreme Court jury returned the verdict on Sunday, deciding it was not proved beyond a reasonable doubt that Eric Kirkpatrick, 63, deliberately planned to kill his ex-boss when he brought a gun to Tall-Grass Distribution's Christmas party in 2008, the day after he was fired.
Outside court, Banky's widow Linda Rae struggled to contain her emotions, saying she was "a bit disappointed" that the jury opted for less than a first-degree murder conviction.
